APPLE, SAMSUNG FACE LAWSUIT FOR HANDSETS EMITTING HARMFUL RADIATIONS

SEPTEMBER 2, 2019: Top global smartphone giants — Apple and Samsung — have been charged in the US for emitting harmful radiofrequency waves or radiation through their smartphones. According to reports, Apple had miscalculated the radio frequency information and the SAR values of its smartphone.

The allegations against the smartphone companies are that the Radio Frequency radiation and the SAR values emitted from smartphone devices designed and manufactured by Apple and Samsung has surpassed the legal limits set by the Federal Communications Commission (FCC) in the US.

As per the suit, the company misled customers by not telling them about the potential ill effects from iPhone’s harmful RF exposure. The US District Court for the Northern District of California has stated that Apple and Samsung’s smartphone has exceeded the radiation limit set by the Federal Communications Commission.

Apple iPhone 7 Plus, iPhone 8, iPhone X,  Samsung Galaxy S8 , and Samsung Galaxy Note 8 have been alleged for causing havoc to health due to high SAR (specific absorption rate) way beyond the prescribed
limits.

The court filing states that the radiations affect living organisms and can have adverse effect on the human brain, increase in harmful free radicals, genetic damages, structural and functional changes of the reproductive system and can even cause cancer cause various disease.

The recent report by the Chicago Tribune show that Apple and Samsung Smartphone handsets emit the highest level of radiation. Chicago Tribune had run a test and the results states that the radio frequency
radiation from the iPhone 7 has exceeded the legal safety limit set by the FCC. The radio-frequency radiation exposure is double than what Apple had reported to the federal regulators by their own tests.

However, the Apple has stated the reports as inaccurate as according to them the test procedures were not in compliance with the procedures to evaluate and determine the iPhone models. Apple has told the Chicago Tribune it is in compliance with all applicable exposure guidelines and limits. Moreover, Samsung has also denied the allegations and said that they have all their devices covered and certified by the FCC in all the countries where their devices are sold.

Yet another study conducted by American Cancer Society revealed that smartphones release a form of energy known as radiofrequency waves, and raised concerns that the cell phones increase the risk of brain tumors and other tumors in various parts of the body.

“The lawsuit filed with the US District Court in California claims higher radiation levels from certain Apple and Samsung devices that can have harmful impact on health after prolonged exposure”, says Hanish Bhatia, Senior Analyst, Devices & Ecosystem, Counterpoint Research.com.

“It provides lab test reports by RF Exposure Lab and various other recent scientific publications, as evidence. Both Apple and Samsung have claimed that their devices comply with the local standards set by the Federal Communications Commission (FCC). Global, there isnt any universal guideline for a safe level of phone radiation. Devices comply with the law for SAR value (Specific Absorption Rate) set by local regulatory bodies. In India and US, SAR value for phones is set at a maximum of 1.6 W/kg”, adds Hanish.

“From 1st Sept. 2013, only the mobile handsets with revised SAR value of 1.6 W/kg are permitted to be manufactured or imported in India. This is a safe limit. However a robust vigilance mechanism is needed (like all Indian regulations) to ensure that this regulation is implemented in letter and spirit. Best way to
achieve this goal is by active involvement of Consumer Organisations which should be institutionalized by all the regulating agencies”, cites Prof Sri Ram Khanna, Managing Editor, Consumer Voice.

Mr. Khanna who is a Former Head & Dean of Commerce, Delhi School of Economics, said “ India has one of the best regulation (in International comparison) prescribed both for Tower radiation as well as Mobile Handset radiation to protect its citizen. However, the regulations are not properly implemented”.
